Booking and Payment

• When you book a tour or activity with us, you agree to pay the specified fees for the service.
• Payment must be made in full at the time of booking unless otherwise specified.
• We accept payment by credit/debit card, PayPal, or other methods as indicated on our website.
• Prices are subject to change without notice, but once a booking is confirmed, the price is locked in.

Cancellation and Refunds

• You may cancel your booking and receive a full refund if you cancel within the specified cancellation period, which varies        depending on the tour or activity.
• No refunds will be provided for cancellations made outside the specified cancellation period, unless otherwise determined by us.
• In the event that we need to cancel a tour or activity due to unforeseen circumstances, we will provide a full refund or offer an alternative date or tour, at your discretion.

Participant Requirements

• Participants must meet any age, health, or fitness requirements specified for the tour or activity.
• We reserve the right to refuse participation or remove participants from a tour or activity if they do not meet these requirements or if their behavior is disruptive or poses a risk to themselves or others.

Liability

• We are not responsible for any loss, damage, injury, or expense incurred as a result of your participation in our tours and activities, except to the extent caused by our negligence or breach of these Terms.
• You agree to release, indemnify, and hold us harmless from any claims, liabilities, damages, or expenses arising out of your use of our services.

Intellectual Property

• All content on our website and mobile application, including text, images, videos, and logos, is the property of Caribbeanly Experiences or our licensors and is protected by copyright and other intellectual property laws.
• You may not reproduce, distribute, or create derivative works based on our content without our prior written consent.

Changes to Services or Terms

• We reserve the right to modify, suspend, or discontinue any aspect of our services at any time, with or without notice.
• We may also revise these Terms from time to time by posting the updated Terms on our website. Your continued use of our services constitutes acceptance of the revised Terms.

Governing Law

• These Terms are governed by the laws of Sint Maarten. Any disputes arising out of or relating to these Terms or our services will be resolved exclusively by the courts of Sint Maarten.
